These Terms of Service ("Terms") govern your use of the FirstFame website and the social media growth services provided by VWP Digital Ltd, trading as FirstFame ("FirstFame", "we", "us"). By subscribing to a plan or using our services, you agree to these Terms.
1. Our services
FirstFame provides organic social media growth services for Instagram, TikTok and YouTube, including audience research, content strategy, creator collaboration coordination, profile optimisation, reporting and, where agreed, management of platform-native promotion. The specific inclusions depend on the plan you choose, as described on our website at the time of purchase.
We do not offer shortcuts, likes, views or any other engagement, and we do not use automation, bots or any tactic that violates the terms of the platforms we work with.
2. No account credentials
We use only official partner tools provided by each platform where access is needed, which you can revoke at any time. You remain the owner and controller of your accounts at all times.
3. Your responsibilities
- You are responsible for the content published on your accounts and for complying with each platform's terms and community guidelines.
- You confirm you own, or have permission to use, any content, trademarks or materials you provide to us.
- You agree to provide timely access to the information we reasonably need to deliver the service, such as analytics screenshots or exports.
- Any advertising spend for platform-native promotion is paid directly by you to the platform and is not included in your plan fee unless agreed in writing.
4. Fees, billing and renewal
Plans are billed in advance on a monthly or annual basis. Monthly plans renew automatically each month and annual plans each year until cancelled. Prices are shown in US dollars and exclude applicable taxes, which will be added where required.
5. Cancellation
You may cancel at any time by emailing hello@firstfame.org. Monthly plans end at the close of the current billing period. Annual plans may be cancelled for a prorated refund of complete unused months.
6. Results and guarantee
Social media growth depends on many factors outside our control, including platform algorithm changes, your niche and the content you publish. Any expectations we discuss with you are estimates, not a guarantee of specific results. Our 30-day strategy review is described in our Refund Policy.
7. Intellectual property
Content plans, scripts, captions and other deliverables we create for you become yours upon payment. We retain ownership of our internal methods, templates and tools. We may reference your account in anonymised form, and in named case studies only with your written permission.
8. Confidentiality
Each party agrees to keep the other's confidential information private and to use it only for the purposes of our working relationship.
9. Limitation of liability
To the extent permitted by law, our total liability under these Terms is limited to the fees you paid in the three months before the claim arose. We are not liable for indirect or consequential losses, or for actions taken by social media platforms. Nothing in these Terms limits liability that cannot be limited by law.
10. Termination
We may suspend or end our services if you materially breach these Terms, ask us to use tactics that violate platform rules, or behave abusively towards us. In those cases, we will refund any prepaid fees for services not yet delivered.
11. Changes
We may update these Terms. We will give clients at least 30 days' notice of material changes by email.
12. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where consumer protection laws in your country of residence give you the right to bring proceedings locally.
